1. Introduction
Welcome to Meal Market.
These Terms of Service, together with our Privacy Policy and any other policies posted by Meal Market, govern your access to and use of Meal Market’s website, mobile application, marketplace, prepared-meal services, seller services, delivery features, payment features, and related services.
For the purposes of these Terms, “Meal Market,” “we,” “us,” or “our” means mealmarket.ca, operating as Meal Market.
By accessing or using Meal Market, creating an account, placing an order, listing food items, selling through the platform, or otherwise using our services, you agree to be bound by these Terms.
If you do not agree with these Terms, you must not use Meal Market.
2. About Meal Market
Meal Market is a local food marketplace and prepared-meal platform.
Meal Market may operate in three main ways:

Meal Market may connect customers with independent food sellers, home-based food businesses, small food businesses, restaurants, commercial kitchens, specialty food providers, and other vendors.Direct Prepared-Meal Seller
Meal Market may prepare and sell its own food items, including healthy and affordable prepared meals, directly to customers.Local Food Discovery and Ordering Platform
Meal Market may help customers discover unique, specialized, cultural, homemade-style, local, or restaurant-based food items that may not be commonly available through larger delivery platforms.
Meal Market may update, expand, limit, or change its services at any time.
3. Acceptance of Terms
By using Meal Market, you confirm that:
You have read and understood these Terms;
You agree to follow these Terms;
You agree to follow any Meal Market policies posted on the website, app, or seller portal;
You are legally able to enter into these Terms;
The information you provide to Meal Market is accurate and complete.
If you use Meal Market on behalf of a business, restaurant, food seller, organization, or other legal entity, you represent that you have authority to bind that entity to these Terms.
4. Eligibility
You must be at least the age of majority in your province or territory of residence to create a seller account or enter into binding seller obligations.
Customers must be legally able to use Meal Market and place orders. If a minor uses Meal Market, they may only do so with the involvement and consent of a parent or legal guardian.
Meal Market may refuse access, suspend accounts, or terminate accounts where we believe a user is not eligible or has violated these Terms.
5. Accounts and Account Security
To use certain features, you may need to create an account.
You agree to:
Provide accurate and current information;
Keep your login details secure;
Not share your account with unauthorized persons;
Notify Meal Market immediately if you suspect unauthorized access;
Be responsible for all activity that occurs under your account.
Meal Market is not responsible for losses caused by your failure to keep your account information secure.
We may suspend, restrict, or terminate accounts if we believe there is fraud, misuse, unauthorized access, legal risk, safety risk, or violation of these Terms.
6. Customer Responsibilities
Customers are responsible for:
Reviewing food listings before ordering;
Checking ingredients, allergen notices, dietary labels, and seller information;
Providing accurate contact, pickup, and delivery information;
Being available to receive orders;
Paying all applicable charges;
Using Meal Market in a lawful and respectful manner;
Reporting order concerns promptly;
Not misusing refunds, chargebacks, reviews, promotions, or support channels.
Customers with allergies, dietary restrictions, religious food requirements, medical food restrictions, or other food sensitivities are responsible for making careful and informed decisions before placing an order.
7. Seller and Vendor Responsibilities
Sellers, vendors, home-based food sellers, restaurants, commercial kitchens, specialty food providers, and other food businesses are independent parties unless expressly stated otherwise.
Each seller is responsible for:
Preparing, handling, storing, packaging, and providing food safely;
Complying with all applicable food safety laws and regulations;
Obtaining and maintaining all required licences, permits, approvals, inspections, and certifications;
Following all applicable health, sanitation, labeling, packaging, and preparation requirements;
Ensuring menu descriptions, photos, prices, ingredients, and allergen information are accurate;
Disclosing material food information honestly;
Fulfilling accepted orders properly and on time;
Paying applicable taxes;
Handling customer concerns professionally;
Maintaining appropriate insurance where required or recommended;
Complying with Meal Market policies and all applicable laws.
Meal Market may require sellers to provide documentation, including business registration, permits, licences, inspection documents, food safety certificates, identification, tax information, or other compliance-related information.
Meal Market may reject, suspend, restrict, or remove sellers at its discretion where there are safety, legal, regulatory, fraud, customer complaint, quality, or platform integrity concerns.
8. Restaurant and Commercial Vendor Responsibilities
Restaurants and commercial vendors are responsible for ensuring that their operations comply with all applicable municipal, provincial, federal, food safety, employment, tax, business licensing, and consumer protection requirements.
Restaurants and commercial vendors are also responsible for:
Maintaining lawful food premises;
Ensuring staff follow food safety standards;
Keeping menus current;
Preparing orders according to customer selections;
Meeting pickup and delivery timelines where possible;
Correcting inaccurate listings;
Managing substitutions or unavailable items properly;
Responding to complaints and investigations.
Meal Market may request additional information from commercial vendors to confirm business status or compliance.
9. Meal Market’s Role as a Platform
When Meal Market acts as a marketplace, Meal Market provides a technology platform that allows customers and independent sellers to connect.
Unless Meal Market expressly identifies itself as the seller of a food item, the seller, restaurant, vendor, or food provider is responsible for the food item, including its preparation, safety, ingredients, description, allergen disclosures, legal compliance, and fulfillment.
Meal Market does not guarantee that seller-provided food will be:
Free from allergens;
Free from cross-contact;
Free from contamination;
Prepared in a specific way;
Suitable for a specific dietary, religious, medical, or nutritional need;
Accurately described in every detail;
Available at all times;
Free from ingredient changes or preparation errors.
Meal Market may take steps to support safety and quality, but Meal Market does not assume responsibility for the independent conduct, food preparation, legal compliance, or omissions of third-party sellers except where required by applicable law.
10. Meal Market’s Own Prepared Meals
Meal Market may prepare and sell its own food items directly to customers.
Where Meal Market is clearly identified as the seller of a food item, Meal Market is responsible for that product only to the extent required by applicable law and the specific terms of sale.
Meal Market may update menus, prices, ingredients, portions, packaging, availability, and meal offerings at any time.
Customers remain responsible for reviewing product descriptions, ingredients, allergen notices, storage instructions, heating instructions, and expiry or best-before information before purchasing or consuming Meal Market-prepared food.
11. Food Listings, Menus, Descriptions, Photos, Prices, and Availability
Food listings may include descriptions, photos, prices, ingredients, dietary labels, preparation notes, availability, pickup times, delivery options, and seller information.
Sellers are responsible for the accuracy of their listings.
Meal Market may edit, remove, reject, suspend, or restrict any listing that we believe:
Is inaccurate or misleading;
Creates safety or legal risk;
Violates these Terms;
Violates Meal Market policies;
Violates applicable law;
Receives significant customer complaints;
Is otherwise inappropriate for the platform.
Photos are for general reference only. Actual food appearance, portion size, packaging, ingredients, and presentation may vary.
Prices and availability may change without notice.
12. Orders
When a customer places an order through Meal Market, the order may be accepted, rejected, modified, cancelled, or delayed depending on availability, seller acceptance, delivery availability, payment status, safety concerns, or platform conditions.
An order is not guaranteed until it is accepted and confirmed through the platform.
Meal Market may cancel or refuse an order for reasons including:
Item unavailability;
Seller unavailability;
Payment failure;
Suspected fraud;
Incorrect pricing;
Delivery limitations;
Safety concerns;
Legal or regulatory concerns;
Platform error;
Customer misuse;
Seller compliance concerns.
13. Substitutions and Item Changes
Some food items may become unavailable after an order is placed.
Where permitted, a seller or Meal Market may offer a substitution, replacement, refund, credit, or cancellation.
Customers may not always be entitled to a substitution. If a customer has allergies or strict dietary requirements, they should not accept substitutions unless they are satisfied that the substitute item is safe and appropriate for them.
14. Cancellations
Cancellation rules may vary depending on the type of order, seller, preparation status, scheduled time, delivery status, and whether the item is custom, perishable, prepared-to-order, or already in progress.
Meal Market may establish cancellation windows and may refuse cancellations once preparation has started or once an order has been accepted by a seller.
Meal Market may cancel orders at its discretion where there are safety, fraud, legal, regulatory, customer complaint, delivery, payment, or platform integrity concerns.
15. Payments, Fees, Taxes, and Charges
Customers agree to pay all charges shown at checkout, which may include:
Food item prices;
Service fees;
Delivery fees;
Small order fees;
Taxes;
Tips, where available;
Other applicable charges.
Prices, fees, and taxes may vary based on location, seller, delivery method, promotions, or platform rules.
Meal Market may use third-party payment processors. By placing an order, you authorize Meal Market and its payment processors to charge your selected payment method.
Meal Market is not responsible for payment delays, bank fees, overdraft charges, card issuer fees, foreign exchange fees, or other charges imposed by third parties.
16. Seller Payouts
Sellers may receive payouts according to Meal Market’s seller policies, payout schedule, payment processor requirements, and any applicable seller agreement.
Meal Market may deduct or withhold amounts for:
Platform fees;
Service fees;
Payment processing fees;
Refunds;
Chargebacks;
Customer credits;
Taxes where applicable;
Adjustments;
Penalties or amounts owed to Meal Market;
Suspected fraud or policy violations;
Legal or regulatory requirements.
Seller payout terms may be further addressed in a separate seller agreement or vendor policy.
17. Refunds, Credits, Chargebacks, and Disputes
Refunds and credits are not automatic and may be handled at Meal Market’s discretion, subject to applicable law.
Meal Market may consider refunds or credits where:
An order was not received;
The wrong item was provided;
An item was materially different from the listing;
An order was cancelled by the seller or Meal Market;
There was a verified delivery issue;
There was a verified food safety or quality concern;
Meal Market determines that a refund or credit is appropriate.
Meal Market may deny refunds or credits where:
The customer provided incorrect delivery information;
The customer was unavailable to receive the order;
The customer changed their mind after preparation began;
The issue was reported too late;
The claim appears false, abusive, or fraudulent;
The item matched the listing in all material respects;
The customer failed to review ingredients or allergen information.
Customers agree to contact Meal Market first to resolve payment or order disputes before initiating a chargeback.
Meal Market may suspend accounts involved in excessive, abusive, fraudulent, or improper refund or chargeback activity.
18. Pickup, Delivery, and Scheduled Orders
Meal Market may offer pickup, delivery, or scheduled ordering options depending on seller availability, location, platform capability, and delivery partner availability.
Customers are responsible for providing accurate pickup or delivery information and being available at the scheduled time.
Delivery times are estimates only and are not guaranteed. Delays may occur due to traffic, weather, seller preparation time, driver availability, incorrect addresses, building access issues, platform errors, or other circumstances.
Meal Market is not responsible for delays outside its reasonable control.
19. Third-Party Delivery Partners, Drivers, and Couriers
Meal Market may use third-party delivery partners, independent drivers, couriers, or logistics providers.
Where third-party delivery providers are used, they may operate independently from Meal Market. Meal Market is not responsible for the acts, omissions, delays, conduct, accidents, or failures of third-party delivery providers except where required by law.
Meal Market may share necessary order and delivery information with delivery partners to complete orders.
20. Food Safety, Licensing, Permits, and Compliance
Food safety is an important part of Meal Market’s platform.
Independent sellers, home-based food businesses, restaurants, commercial kitchens, and vendors are responsible for understanding and complying with all laws and regulations that apply to them.
This may include requirements related to:
Food handling;
Food preparation;
Food storage;
Food transportation;
Food packaging;
Food labeling;
Food safety training;
Business licensing;
Home-based business rules;
Municipal permits;
Health inspections;
Tax obligations;
Allergen disclosure;
Consumer protection laws.
Meal Market may request compliance documents, but any review by Meal Market does not guarantee that a seller is fully compliant with all legal requirements.
Meal Market may suspend, remove, or restrict sellers or listings where we believe there is a food safety concern, legal risk, customer complaint, regulatory issue, or policy violation.
21. Allergies, Dietary Restrictions, and Cross-Contact
Customers with allergies, intolerances, sensitivities, religious dietary requirements, medical dietary needs, or other restrictions must use caution when ordering.
Seller-provided food may contain or come into contact with allergens, including but not limited to:
Peanuts;
Tree nuts;
Milk;
Eggs;
Wheat;
Soy;
Fish;
Shellfish;
Sesame;
Mustard;
Gluten;
Other ingredients or allergens.
Meal Market does not guarantee that seller-provided food is free from allergens, cross-contact, ingredient changes, contamination, mislabeling, or preparation errors.
Customers are responsible for reviewing listings, contacting the seller where available, and deciding whether a food item is suitable for them.
Meal Market is not responsible for allergic reactions, dietary reactions, or health consequences caused by seller-provided food except where required by applicable law.
22. Customer Reviews, Ratings, and User Content
Meal Market may allow users to post reviews, ratings, comments, photos, messages, feedback, or other content.
By submitting content, you grant Meal Market a non-exclusive, worldwide, royalty-free, transferable, sublicensable licence to use, display, reproduce, modify, distribute, publish, and promote that content in connection with Meal Market’s services, marketing, platform operation, and business activities.
You are responsible for the content you submit.
You agree not to submit content that is:
False or misleading;
Defamatory;
Harassing or abusive;
Obscene or inappropriate;
Discriminatory;
Infringing on intellectual property rights;
Fraudulent;
Unlawful;
Unrelated to a genuine customer experience;
Intended to manipulate ratings or reviews.
Meal Market may remove, edit, restrict, or refuse content at its discretion.
23. Prohibited Conduct
You must not:
Use Meal Market for unlawful purposes;
Provide false or misleading information;
Create fake accounts;
Impersonate another person or business;
Misuse payment systems;
Abuse refunds, credits, promotions, or chargebacks;
Harass, threaten, or abuse customers, sellers, drivers, or Meal Market staff;
Post false reviews;
Interfere with platform security;
Scrape, copy, or misuse platform data;
Upload harmful code or malware;
Attempt unauthorized access;
Use Meal Market to sell prohibited, unsafe, illegal, or misrepresented products;
Violate food safety or consumer protection laws;
Damage Meal Market’s reputation, systems, users, or business operations.
24. Platform Rules and Enforcement
Meal Market may monitor platform activity and enforce these Terms.
Meal Market may take action including:
Warning users;
Removing listings;
Cancelling orders;
Refusing service;
Suspending accounts;
Terminating accounts;
Withholding payouts;
Issuing refunds or credits;
Investigating complaints;
Reporting unlawful activity;
Cooperating with legal authorities;
Restricting access to features.
Meal Market may take these actions at its discretion where we believe there are safety, fraud, legal, regulatory, complaint, payment, quality, or platform integrity concerns.
25. Suspension or Termination
Meal Market may suspend, restrict, deactivate, or terminate your account or access to services at any time if we believe you have:
Violated these Terms;
Violated Meal Market policies;
Created safety or legal risk;
Misused the platform;
Engaged in fraud or abuse;
Failed to pay amounts owed;
Provided inaccurate information;
Created customer complaints or seller complaints;
Failed to meet seller requirements;
Harmed Meal Market, users, sellers, drivers, or third parties.
You may stop using Meal Market at any time. Certain obligations, including payment obligations, indemnity, intellectual property rights, disclaimers, limitations of liability, dispute provisions, and record retention provisions, will survive account closure.
26. Intellectual Property
Meal Market owns or licenses the Meal Market name, logo, branding, website, app, designs, text, graphics, software, platform layout, features, systems, and other content created by or for Meal Market.
You may not copy, reproduce, modify, distribute, sell, reverse engineer, scrape, or exploit Meal Market’s intellectual property without written permission.
Using Meal Market does not give you ownership of any Meal Market intellectual property.
27. Seller and Vendor Content Licence
Sellers retain ownership of their own photos, logos, descriptions, menus, and other content they provide, subject to the licence granted to Meal Market.
By submitting seller content, sellers grant Meal Market a non-exclusive, worldwide, royalty-free, transferable, sublicensable licence to use, display, reproduce, modify, distribute, publish, advertise, and promote that content in connection with Meal Market’s platform, services, marketing, social media, app listings, and business operations.
Sellers confirm that they have the right to provide all content submitted and that the content does not infringe the rights of any third party.
28. Third-Party Links and Services
Meal Market may include links or integrations with third-party websites, apps, payment processors, delivery providers, social media platforms, analytics tools, mapping services, or other services.
Meal Market does not control and is not responsible for third-party services, content, policies, errors, outages, or practices.
Your use of third-party services may be subject to their own terms and privacy policies.
29. Promotions, Coupons, Credits, and Referral Programs
Meal Market may offer promotions, coupons, discounts, credits, referral rewards, or other offers.
Meal Market may modify, suspend, revoke, limit, or cancel promotions at any time.
Promotions may be subject to additional terms, expiry dates, location limits, user limits, order minimums, seller exclusions, or other restrictions.
Promotional credits have no cash value unless required by law.
Meal Market may revoke promotions or credits if we believe there is fraud, misuse, abuse, technical error, or violation of promotion terms.
30. Disclaimers of Warranties
Meal Market provides its services on an “as is” and “as available” basis.
To the maximum extent permitted by law, Meal Market does not guarantee that:
The platform will always be available;
Orders will always be accepted;
Sellers will always be available;
Food items will always be available;
Delivery will always be on time;
Listings will always be error-free;
Seller-provided food will meet every expectation;
The platform will be free from errors, interruptions, bugs, or security issues;
Third-party services will operate without interruption.
Nothing in these Terms limits rights that cannot legally be limited under applicable consumer protection laws.
31. Limitation of Liability
To the maximum extent permitted by law, Meal Market and its owners, directors, officers, employees, contractors, affiliates, agents, service providers, and representatives will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, loss of data, loss of goodwill, loss of business, personal inconvenience, or emotional distress arising from or related to your use of Meal Market.
To the maximum extent permitted by law, Meal Market’s total liability for any claim related to the services will be limited to the amount paid by you to Meal Market for the specific order or service giving rise to the claim, or $50, whichever is greater.
This limitation applies whether the claim is based in contract, tort, negligence, strict liability, statute, or any other legal theory.
Some jurisdictions do not allow certain limitations of liability, so some limitations may not apply to you.
32. Indemnification
You agree to defend, indemnify, and hold harmless Meal Market and its owners, directors, officers, employees, contractors, affiliates, agents, service providers, and representatives from and against any claims, damages, losses, liabilities, costs, expenses, penalties, fines, and legal fees arising from or related to:
Your use of Meal Market;
Your violation of these Terms;
Your violation of applicable law;
Your violation of another person’s rights;
Your content or listings;
Your food preparation, sale, handling, labeling, packaging, storage, or delivery;
Your failure to comply with food safety, licensing, tax, or regulatory obligations;
Your misuse of customer information;
Your negligence, misconduct, fraud, or omission.
For sellers, this indemnity includes claims related to food safety, allergens, contamination, illness, injury, mislabeling, false advertising, permit issues, customer complaints, and regulatory violations connected to the seller’s products or conduct.
33. Dispute Resolution
If a dispute arises, you agree to first contact Meal Market and attempt to resolve the issue informally.
Meal Market may offer support, refunds, credits, investigation, or other resolution options at its discretion.
If the dispute cannot be resolved informally, the dispute will be handled according to the laws of Saskatchewan, Canada, unless another process is required by applicable law.
Nothing in these Terms prevents Meal Market from seeking urgent legal relief where necessary to protect its platform, users, intellectual property, confidential information, business operations, or legal rights.
34. Governing Law
These Terms are governed by the laws of the Province of Saskatchewan and the applicable federal laws of Canada.
You agree that any legal proceeding related to these Terms or Meal Market will be brought in the courts located in Saskatoon Saskatchewan, unless applicable law requires otherwise.
35. Changes to These Terms
Meal Market may update these Terms from time to time.
When changes are made, Meal Market may update the “Last Updated” date at the top of this page. For significant changes, Meal Market may provide additional notice through the website, app, email, or account notification.
Your continued use of Meal Market after updated Terms are posted means you accept the updated Terms.
If you do not agree with the updated Terms, you must stop using Meal Market.
36. Privacy
Meal Market’s collection, use, storage, and disclosure of personal information is described in our Privacy Policy.
By using Meal Market, you agree to the handling of your personal information as described in the Privacy Policy.
37. App Store and Mobile App Terms
If you download Meal Market through the Apple App Store, Google Play Store, or another app marketplace, your use of the app may also be subject to the terms and policies of that app marketplace.
Meal Market is responsible for the Meal Market app and services, not the app marketplace provider, except where the app marketplace provider’s terms state otherwise.
You agree to comply with all applicable third-party app store terms when using the Meal Market mobile app.
38. Electronic Communications
By using Meal Market, you agree to receive electronic communications from Meal Market, including:
Order confirmations;
Account notices;
Payment notices;
Seller notices;
Support messages;
Policy updates;
Security alerts;
Marketing messages, where permitted.
You may unsubscribe from marketing communications where available. However, Meal Market may still send necessary service-related communications.
39. No Waiver
If Meal Market does not enforce a provision of these Terms, that does not mean Meal Market waives the right to enforce that provision later.
40. Severability
If any part of these Terms is found to be invalid, unlawful, or unenforceable, the remaining parts will continue in effect to the fullest extent permitted by law.
41. Entire Agreement
These Terms, together with the Privacy Policy and any additional Meal Market policies or seller agreements, form the entire agreement between you and Meal Market regarding your use of the services.
For sellers, additional seller agreements, vendor policies, payout terms, or onboarding documents may also apply.
